ARTICLE 2 – SCOPE OF APPLICATION
These Terms & Conditions apply to all offers, orders, purchases and agreements concluded via Modelita.nl. By using our website and placing an order, you agree to these Terms & Conditions.
Consumer rights under mandatory European and national law remain unaffected by these Terms & Conditions.
ARTICLE 3 – OFFER AND PRICES
All prices shown on Modelita.nl are in euros and include VAT. We reserve the right to adjust prices and product information at any time.
The price applicable at the time of completing your purchase (checkout) is binding for both Modelita.nl and the customer. Obvious mistakes or typographical errors in prices or product information do not create any obligation for Modelita.nl.
ARTICLE 4 – ORDERS AND PAYMENT
After placing an order, you will receive an order confirmation by e-mail. The agreement comes into effect once payment has been successfully completed.
Payments can be made using various methods such as iDEAL, Bancontact, credit card, Apple Pay and other available options at checkout. All payments are processed securely via Mollie Payments and/or other certified payment providers.
Modelita.nl reserves the right to cancel an order, for example in case of suspected fraud, incorrect customer details or a clear pricing error. In such cases, any amounts already paid will be refunded as soon as reasonably possible.
ARTICLE 5 – DELIVERY
We aim to ship your order within 1–3 business days after payment has been received. Our shipping is free within the European Union and includes Track & Trace.
Average delivery times after shipment are indicated in our Shipping Policy . The legal maximum delivery time within the EU is 30 days , unless another delivery term has been expressly agreed. If delivery cannot take place within 30 days, you have the right to cancel the purchase and receive a full refund.
Orders may be delivered in multiple parcels. This does not affect the shipping costs for the customer.
ARTICLE 6 – RIGHT OF WITHDRAWAL
As a consumer within the European Union, you have the right to withdraw from the agreement within 14 days after receiving your order, without giving any reason.
After notifying us of your withdrawal, you have another 14 days to return the products. More detailed information about how to register and send your return can be found in our Return Policy .
Unless explicitly stated otherwise or if we are at fault, return shipping costs are in principle borne by the customer. In certain cases (for example your first return within the Netherlands) we may offer free return shipping as described in our Return Policy.
We will refund the full purchase amount including any original shipping costs within 14 days after you have notified us of your withdrawal. We are entitled to wait with the refund until we have received the products back, or until you have provided proof that the products have been returned.
ARTICLE 7 – RETURN CONDITIONS
During the reflection period you may inspect and try the product as you would in a physical store. Products should be returned, where reasonably possible, in their original condition and packaging, including labels and accessories.
If a product has been used more extensively than necessary to determine its nature, characteristics and functioning, Modelita.nl may charge a depreciation fee. This value reduction will be deduced from the refund amount in accordance with applicable consumer law.
For hygienic reasons, certain products such as earrings or underwear can only be returned if they are unopened, unused and with the hygiene seal intact.
ARTICLE 8 – WARRANTY AND COMPLAINTS
We apply the statutory warranty as laid down in European consumer law: a product must meet what you may reasonably expect from it.
If you have a complaint or notice a defect, please contact us as soon as possible via info@modelita.nl . We aim to respond within 48 hours on business days and always look for a fair solution.

ARTICLE 9 – LIABILITY
Modelita.nl is not liable for damages resulting from improper use of products or from incorrect or incomplete information provided by the customer.
To the extent permitted by law, any liability of Modelita.nl is limited to the direct damage and to a maximum of the purchase amount of the product concerned. This limitation of liability does not apply in cases of intent, gross negligence or where mandatory consumer law provides otherwise.
ARTICLE 10 – FORCE MAJEURE
In the event of force majeure, Modelita.nl is not obliged to fulfill its obligations. Force majeure includes, but is not limited to: natural disasters, pandemics, strikes, war, government measures, disruptions in transport, failures of third parties, extreme busy periods or technical outages.
In such situations, we reserve the right to suspend the execution of the agreement or to cancel the order, without being liable for any compensation. Any amounts already paid for undelivered products will be refunded.
ARTICLE 11 – APPLICABLE LAW
All agreements and disputes between you and Modelita.nl are governed exclusively by Dutch law, without prejudice to mandatory consumer protection provisions under the law of your country of residence within the European Union.
